July 2014 – Bushfire Prone Land Regulation

The Environmental Planning & Assessment (Bushfire Prone Land) Regulation 2014, published 30 May 2014, amends the EPA Regulation to exclude certain development applications for the erection of various types of dwellings on bushfire prone land in urban release areas from the operation of section 79BA of the EPA Act.

The Rural Fires Amendment (Bushfire Safety Authorities) Regulation 2014, also published 30 May 2014, amends clause 44 of the Rural Fires Regulation 2013 to provide the information that must accompany an application for a Bushfire Safety Authority for proposed development that is subdivision for the purposes of certain types of dwellings on property that is in an urban release area, and that the applicant specifies that it wishes the Commissioner to consider whether it would be appropriate for the future erection of the dwellings to be excluded from the application of section 79BA of EPA Act.
